Michael Jordan Tells Court He Felt No Fear of Nascar in Antitrust Trial
The basketball icon, as he cordially introduced himself in a Charlotte court on Friday, admitted that his drive to win and novelty within the sport emboldened his effort with 23XI Racing to “challenge” Nascar over perceived violations of competition laws.
Team Investment and a Competitive Drive
The owner disclosed operational insights of his racing venture, saying he put in $40m of his own funds into the Cup Series operation co-founded with business partner Curtis Polk and driver Hamlin.
“Someone had to step forward,” Jordan said during testimony. “I was a new person, I wasn’t afraid. I believed I could take on Nascar in its entirety. From my perspective, the sport it needed to be looked at from a different view.”
The Core Dispute: Franchise System and Renewal Demands
The heart of the case involves the expiration of a 2016 agreement where Nascar provided each team a franchise. The concept is similar to other professional sports with independent franchises, like the Charlotte Hornets or the Carolina Panthers. This deal was due to end in 2024 when Nascar demanded teams renew their charters.
Jordan was on the witness stand for about sixty minutes and left the court to pandemonium, with fans and media clamoring for a view or a photo of the sports legend.
Leading the Legal Charge
Jordan’s 23XI is at the forefront of the push along with Front Row Motorsports for Nascar to change a operating model Jordan said is breaking the law to keep two hands on the wheel.
For Jordan and and Heather Gibbs, who testified before Jordan, are events from last September. She recounted a hectic and tense six hours where the sanctioning body informed teams they had to sign a contract extension. This agreement spanned over a hundred pages outlining pay for chartered teams and a guaranteed spot in Nascar-sponsored races.
Choosing Litigation
Jordan explained that his team and its ally decided their only feasible option was to decline to sign that 112-page package and take the issue to court. All other teams signed the agreement.
The team owners approached Nascar about potential amendments or extension options. Nascar wasn’t talking, Jordan said.
The Ultimate Motivation: Winning
But in the end, the pushback against what he saw as a unsustainable system was driven by the familiar goal for Jordan: Winning.
“Hamlin persuaded me getting a third driver boosted our odds of winning,” he said, noting that he bought a third charter last year for $28m amid the legal dispute. “So I took the plunge.”
Heather Gibbs’ Testimony
Gibbs described her request for permanent charters, which she said a written letter to Nascar. She said the pressure of the signature deadline didn’t sit well.
According to her, Joe Gibbs first tried to call and persuade Nascar against demanding signatures, but CEO Jim France refused the appeal.
“Please don’t force this on us,” Gibbs recounted Joe Gibbs told Nascar’s leadership. She said France replied, “Whether I have 20 charters, that’s what I have. If I have 30, that’s the number.”
